    The SCI organization aims to implement a set of uniform procedures to monitor and promote the social responsibility performance of companies producing relevant products through the continuous improvement of development policies.Business Social Compliance Initiative (BSCI) members include retailers, brand companies and traders. Most of them deal with textiles or deal with products that include textiles, and members come from 10 countries in Europe and Canada, with 18 members from the Netherlands, such as HEMA, Bijenkorf, V&D, Claudia Strä;ter, M&S, Hunkemö;ller, WE, Wehkamp and others. There is an increasing amount of discussion about the human rights situation that focuses on the situation in developing or newly industrialized countries that produce consumer goods. In industrialized countries, improving the social standards of the producing countries that supply their retailers has become a very important agenda for many companies. Problems that have arisen in supplying manufacturers around the globe include child labor, forced labor, lack of safety in the workplace, wages that do not even reach the minimum level, interference in the establishment of trade unions, obstruction of the work of employee representatives, excessively long prescribed working hours, excessive overtime and possibly various forms of discrimination. In order to address these issues, codes of conduct have been developed in Europe and around the world by companies, traders and trade associations from retail and industry. These codes are often based on the main labor conventions of the International Labor Organization (ILO) and are designed to improve working conditions in supplier countries. Many countries have established monitoring systems for these codes of conduct, including Finland, France, Germany, the Netherlands, Sweden, the United Kingdom and Canada. The purpose of these codes of conduct and the associated monitoring systems are very similar, even down to their content. The plethora of standards makes it overwhelming for retailers to assume their social responsibility. Their suppliers face the same situation; they are subject to an increasing number of requirements and audit procedures. There is therefore an urgent need for concerted action in both retail and industry. As these issues gain international attention, the need to develop common actions becomes even more urgent. Many international groups have taken the initiative to bring the issue to the forefront of internal discussions, such as the United Nations' Global Plan of Action, the Organization for Economic Co-operation and Development's (OECD) Principles for Multinational Enterprises, and the World Trade Organization (WTO). The World Trade Organization (WTO), for example, is considering the inclusion of social standards in multilateral trade regulations. The European Commission also issued a joint communiqué on social issues in 2002. Some companies and associations, such as the Foreign Trade Association, are also involved in discussions and initiatives. However, the European retail industry places more emphasis on the principle of voluntarism than on enforcement, and adheres to the corresponding governmental and organizational requirements in the international community. Since 2002, the Foreign Trade Association (FTA), based in Brussels, Belgium, has been working to establish a common platform for the many different codes of conduct and monitoring systems in Europe and to lay the foundations for a common European monitoring system. Between 2002 and 2003, major retail companies and associations organized seminars to develop a framework for such systems, and in March 2003 FTA formally established the Business Social Compliance Initiative (BSCI) with the aim of developing implementation measures and procedures for the European Business Social Compliance Initiative (EBSCI).

  • Appearance patents
    A design patent is the object of a patent right, the object of protection under the patent law, and refers to a design for which a patent right should be granted in accordance with the law. It is completely different from invention or utility model, i.e. design is not a technical program. [2] A design is a design program for the appearance of a product. In Article 2 of China's Patent Law, it is stipulated that “design means a new design which is aesthetically pleasing and suitable for industrial application of the whole or a part of a product in terms of its shape, pattern or combination thereof, as well as the combination of color and shape or pattern.”It can be seen that a design patent should meet the following requirements: (1) It is a design of shape, pattern or combination thereof and combination of color and shape or pattern; (2) It must be a design of the product as a whole or in part; (3) It must be aesthetically pleasing; (4) It must be suitable for industrial application; (5) It must be a new design.

  • Invention patents
    As a kind of intellectual property rights, invention patents naturally have the general characteristics of intellectual property rights, namely, temporality, territoriality, incorporeality and exclusivity. However, compared with other types of patents, invention patent has its own characteristics.1. Higher application difficulty For the creativity of invention patent, China requires that the invention has outstanding substantive features and significant progress compared with the technology existing before the filing date; while for utility model, it only requires that there are substantive features and progress compared with the technology existing before the filing date. The invention emphasizes the “outstanding substantive features” and “significant progress”, which shows that the creativity requirement of the invention patent is higher than that of the utility model patent, and its application is more difficult. 2. Higher technical value As the application of invention patent requires higher creativity of technical solutions, and not only needs to conduct formal examination, but also needs to conduct substantive examination, so the technical value of the invention that finally obtains the corresponding patent right is higher. For example, the number of invention patents is stipulated in the SEC's “Guidelines for Evaluation of Science and Technology Creation Attributes” as an important indicator for applying for listing on the Science and Technology Creation Board (STB). In addition, if an enterprise has a certain number of invention patents it is also conducive to being recognized as a high-tech enterprise and applying for government funding subsidy programs. 3. Relatively stable rights Even if a patent application is granted, the patent right may still be invalidated later. Compared with utility models and designs, inventions tend to be more stable due to the substantive examination in the authorization process. The higher stability makes the invention patent produce greater commercial value in cooperation. 4. Longer protection period Different types of inventions have different protection periods. In China, the protection period of invention patent right is 20 years, calculated from the date of application, and its protection period is longer compared with the other two types of patents. In the latest revision of the Patent Law, a term compensation system has been added for invention patents. After the protection period, the patent enters the public domain. 5. Larger scope of objects An invention can be a product invention or a method invention, while the object of a utility model is limited to the shape of the product, its composition, or the combination thereof, which is a practical new technical solution. A method of manufacturing cannot be patented as a utility model, and in addition, a product unrelated to shape, composition, or combination thereof cannot result in a utility model patent. It can be seen that the scope of the object of the invention is wider than the utility model, not only limited to the shape of the product, structure or combination of new designs, but also new production methods. 6. Longer examination time Patent application for invention is deemed to meet the requirements after preliminary examination, and will be published within eighteen months from the date of application, or may be published early according to the request of the applicant, and will enter the stage of substantive examination within three years from the date of application. It can be seen that the patent application needs to go through a long examination process. In practice, an invention application usually takes more than 2~3 years to be authorized. With the improvement of China's patent priority examination system, patent pre-examination system and patent examination highway (PPH) system, the problem of longer patent examination time is expected to be solved. 7. Higher cost Compared with utility models and designs, inventions require a higher amount of money both in terms of filing fees, registration fees, annual fees after granting, re-examination request fees and invalidation request fees. In addition, due to the higher difficulty of invention application, the patent application agency often charges relatively higher agency fees for invention patents.
